Terms of Use
These Terms of Use (“Terms”) govern your use of the Supa Sample browser extension and the supasample.com website (together, the “Service”), provided by Michael Otto / Supa Sample (“we,” “us,” or “our”). By installing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What Supa Sample does. Supa Sample is a browser extension that detects the musical key and BPM of audio playing in a browser tab and can record that tab’s audio to a file on your device. All analysis runs locally on your device.
2. License to use. We grant you a personal, worldwide, non-exclusive, revocable license to use the Service for its intended purpose, subject to these Terms. You may use it for personal or commercial music work. You may not resell, redistribute, decompile, reverse-engineer, or create derivative works of the extension, except to the extent this restriction is prohibited by applicable law.
3. Your responsibilities and acceptable use. You are solely responsible for how you use the Service and for any audio you record or capture with it. You agree that you will: only record or use audio that you own, created, or otherwise have the legal right to record and use (for example, royalty-free, Creative Commons, or licensed material); comply with all applicable copyright and other laws; and comply with the terms of service of any website or platform whose audio you access. You agree that you will NOT use the Service to: infringe the copyright or other rights of any person; circumvent digital rights management (DRM) or other technical protection measures; or violate any applicable law or the terms of any third-party service. Supa Sample is a general-purpose analysis and recording tool with substantial legitimate uses. We do not host, store, upload, transmit, or distribute any audio you record — recordings are saved only to your own device, and what you do with them is your responsibility.
4. No guarantee of accuracy. The musical key, BPM, and other information the Service provides are automated estimates and may be inaccurate or incomplete. You should not rely on them as definitive. The Service is provided for reference and creative purposes only.
5. Disclaimer of warranties. The Service is provided to you free of charge. To the extent permitted by law, we provide it “as is” and do not warrant that it will be uninterrupted, error-free, or secure, or that its results — including the detected key, BPM, and other information — will be accurate or complete (see Section 4). Your mandatory statutory rights, including any statutory warranty rights you may have as a consumer, remain unaffected.
6. Liability. We are liable without limitation for damages resulting from injury to life, body, or health, and for damages caused by intent or gross negligence on our part. In the event of slight negligence, we are liable only for the breach of a material contractual obligation (i.e. an obligation whose fulfilment is essential to the proper performance of these Terms and on which you may reasonably rely), and in such cases our liability is limited to the foreseeable damage typical for an agreement of this kind. Any further liability on our part is excluded. Liability under the German Product Liability Act (Produkthaftungsgesetz) and any other mandatory statutory liability remain unaffected. You remain solely responsible for how you use the Service and for any audio you record or process with it (see Section 3).
7. Intellectual property. The Supa Sample extension, website, name, and logo are owned by us and protected by intellectual-property laws. These Terms do not grant you any rights in our trademarks or branding.
8. Third parties and trademarks. Supa Sample is not affiliated with, endorsed by, or sponsored by YouTube, SoundCloud, Bandcamp, or any other third-party website or service. All product names, trademarks, and registered trademarks are the property of their respective owners and are used only to describe compatibility.
9. Privacy. Your use of the Service is also governed by our Privacy Policy, which explains that the Service runs entirely on your device and collects no personal data.
10. Changes to the Service and these Terms. We may modify or discontinue the Service, or update these Terms, at any time. If we make material changes to these Terms, we will update the effective date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
11. Termination. You may stop using the Service at any time by uninstalling the extension. We may suspend or terminate your access to the Service if you violate these Terms.
12. Governing law. These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer habitually resident in the European Union or European Economic Area, you additionally enjoy the protection of any mandatory provisions of the law of your country of residence that cannot be derogated from by agreement.
